Nevada police: Driver was on drugs at time of fatal accident

Most Nevada drivers try their best to abide by traffic safety laws and to generally be careful drivers. Unfortunately, they sometimes have to share the road with people who are not nearly as responsible.

Recently, Nevada Highway Patrol officers arrested a 22-year-old man who was involved in an accident that killed a man who was changing a tire by the side of a highway. Originally, police said the driver had been affected by a diabetic condition at the time of the accident. Later, they said the 22-year-old man told them he had taken drugs, including Oxycodone and intravenous heroin before the accident.

The driver now faces multiple charges for causing a fatal accident while driving while under the influence of drugs, among other alleged crimes.

After fatal car accidents caused by drunk drivers, the criminal justice system obviously has an important role to play in restoring the public's sense of safety and justice. However, the criminal justice system is not the only way to hold a negligent driver accountable.

Nevada law provides that after someone is killed in an accident caused by driver negligence, family members of the victim may receive compensation for their damages by filing a wrongful death lawsuit. A wrongful death suit may take place when a driver acts negligently by failing to exert the same level of attention that a rational person would exercise in the same situation, and a person is injured or killed as a result.
